1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and GenWealth Technology LLC ("Cypress", "we", "us") governing your use of the Cypress mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Not financial, investment, tax, or legal advice
Cypress is an informational tool, not a financial advisor. We are not a bank, broker-dealer, investment adviser, tax preparer, or credit counselor, and we are not a fiduciary. Nothing in the Service — including budgets, projections, charts, categorizations, net-worth figures, or any output of the AI assistant — is financial, investment, tax, or legal advice, or a recommendation to buy or sell any security. We are not a consumer reporting agency, and nothing in the Service is a "consumer report" as defined in the Fair Credit Reporting Act. You may not use the Service to determine anyone's eligibility for credit, insurance, employment, housing, or any other purpose regulated by that Act.
You are solely responsible for your financial decisions. Consult a qualified professional before acting. Past performance does not predict future results, and any forward-looking figure is an estimate, not a guarantee.
3. The AI assistant
The Service includes an AI assistant that answers questions about your finances. Your messages and the financial context needed to answer them are processed by a third-party AI provider (see our Privacy Policy).
AI-generated responses may be inaccurate, incomplete, or misleading, and may misinterpret your data. Verify anything important before relying on it. Do not use the assistant as a substitute for professional advice, and do not enter information you are not comfortable transmitting to a third-party processor.
4. Eligibility and your account
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate registration information and keep it current.
You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@cypressmoney.com if you suspect unauthorized access. You may not share your account or transfer it to anyone else.
5. Linked financial accounts
The Service lets you connect financial institution accounts through Plaid Inc. By connecting an account you authorize us and Plaid to access and retrieve information from that institution on your behalf, and you confirm you are the account holder or otherwise authorized to grant that access. When account information is retrieved from your institution, we and Plaid act on your behalf and at your direction, not on behalf of the institution, and the Service is not endorsed or sponsored by any financial institution. Your use of Plaid is also governed by Plaid's own end user privacy policy.
Account data is provided by your institution and by Plaid. We do not control its accuracy, completeness, or timeliness, and balances or transactions shown in the Service may be delayed or incorrect. Always treat your institution's own records as authoritative. You may disconnect an institution at any time from within the app.
6. Subscriptions and billing
Some features require a paid subscription. Subscriptions are sold through the Apple App Store and managed on our side by a subscription management service.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
- You can manage or cancel your subscription in your Apple ID account settings. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under the App Store terms; we generally cannot issue them directly.
We may change subscription pricing prospectively, with notice before the change takes effect. Any free trial terms will be disclosed at the point of purchase.
7. Apple App Store terms
Because the app is distributed through the Apple App Store, the following additional terms apply:
- These Terms are between you and us, not Apple, and Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims relating to the app — including product liability, legal or regulatory compliance, and consumer protection claims — and for the investigation, defense, and settlement of any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as "terrorist supporting," and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
8. Acceptable use
You agree not to:
- Use the Service unlawfully, or to violate anyone's rights;
- Access accounts or data you are not authorized to access;
- Reverse engineer, decompile, scrape, or attempt to derive source code from the Service, or attempt to extract the models, prompts, or other components underlying the AI assistant;
- Interfere with, overload, or disrupt the Service or its infrastructure, or circumvent rate limits or security controls;
- Upload malicious code, or use the Service to build a competing product;
- Use the Service or the output of the AI assistant to develop or train an artificial intelligence or machine learning model;
- Misrepresent your identity or your authority over a linked account.
9. Your content
You retain ownership of the information and content you submit. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display that content solely to operate and improve the Service for you and as described in our Privacy Policy. This license ends when you delete the content or your account, subject to the retention periods described there.
If you send us feedback, suggestions, or ideas about the Service, you agree that we may use them without restriction or compensation to you.
10. Our intellectual property
The Service, including its software, design, and the Cypress name and logo, is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes under these Terms. No other rights are granted.
11. Third-party services
The Service integrates third-party services, including Plaid, Apple, Google, our subscription management provider, and our AI provider. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them may be governed by their own terms.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data displayed will be accurate or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENWEALTH AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limitations, so they may not fully apply to you.
14. Indemnification
You agree to indemnify and hold harmless GenWealth Technology LLC from any claims, damages, losses, and reasonable legal fees arising out of your use of the Service, your content, or your violation of these Terms or of applicable law.
15. Termination
You may stop using the Service and delete your account at any time from within the app. We may modify or discontinue features of the Service at any time, and may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive termination — including content licenses already granted, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction there. Nothing here prevents either party from seeking relief in small claims court.
17. Changes to these terms
We may modify these Terms from time to time. We will post the updated version here with a new effective date, and for material changes we will provide notice in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
18. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
